1. Scope

These Terms of Use apply to the use of the Coin Atlas website as well as the Android and iOS apps (hereinafter referred to as the "Service"), operated by Andreea Schmid, Hauptstraße 12, 71334 Waiblingen, Germany (hereinafter referred to as the "Operator").

When obtaining, downloading, or using the Android or iOS app via an app store, the respective terms of use of the app store provider apply in addition. These Terms of Use govern exclusively the contractual relationship between the user and the Operator, except where mandatory terms of the respective app store provider take precedence.

By registering for or using the Service, you agree to these Terms of Use.

2. Description of the Service

Coin Atlas is a community platform for recording and displaying souvenir coin machines (including elongated coins, pressed tokens, and tourist coins) on an interactive map. Registered users can add and edit tourist places, locations, machines, and coin motifs, contribute translations, report content, and manage their personal collection.

The Service can be used via the website as well as via Android and iOS apps. The functionality may vary slightly depending on the platform, operating system version, device features, and app version.

3. Registration and User Account

  • Registration is required for certain functions and is free of charge.
  • You are obliged to provide truthful information and to keep your login credentials confidential.
  • You are responsible for all activities carried out under your account.
  • The Operator reserves the right to suspend or delete accounts in the event of a breach of these Terms.
  • The Service may in the future offer paid features or subscriptions. In this case, the price, term, scope of services, payment terms, renewal, and cancellation options will be displayed separately before conclusion. For purchases made through the Android or iOS app, payment, management, and cancellation take place via the respective app store provider; its terms apply in addition.

3.1 Minimum Age

Use of the Service is only permitted for persons who are at least 16 years old.

4. User Content

The Service distinguishes between two types of user content:

4.1 Private User Content and Personal Functions

Private content and personal functions such as bookmarks, personal lists, and collections are visible only to the respective user, unless the user expressly shares them with others.

4.2 Contributions to Location Data

Contributions to location data — in particular descriptions of tourist places, locations, machines, coin motifs, translations, and activity reports — are published under the Creative Commons Attribution 4.0 International (CC-BY-4.0) license and are freely accessible to all users and third parties.

By submitting contributions to location data, you publish these contents under the Creative Commons Attribution 4.0 International License (CC-BY-4.0). You grant the Operator and the general public the worldwide, royalty-free, non-exclusive, and perpetual rights of use described therein. This includes, in particular, reproducing, distributing, making publicly available, editing, translating, and reusing the content under the terms of the CC-BY-4.0 license.

These contents may remain publicly available even after deletion of the user account.

User contributions may be machine-translated into other languages by the Operator in order to make the Service accessible to an international audience. No guarantee is given for the accuracy of machine translations.

4.3 Accuracy of Content

All location and object data on Coin Atlas is provided by users. The Operator does not verify this content for accuracy, completeness, or timeliness and assumes no warranty in this regard. Information about locations, machines, coin motifs, and their availability may be outdated or incorrect. Use of this data is at your own risk. User contributions may be reviewed before publication; such review serves exclusively to protect against spam and to ensure compliance with the rules set out in Section 4.4, but not to verify the accuracy of the content.

4.4 General Rules

  • You warrant that you have the necessary rights to the content you submit and that you do not infringe any third-party rights.
  • It is prohibited to submit content that is unlawful, insulting, discriminatory, harmful to minors, pornographic, glorifies violence, extremist, misleading, promotional, or otherwise clearly off-topic. Factual information about tourist places, historical events, or cultural backgrounds remains permitted.

4.5 Reporting Content

Users may report content that violates these Terms of Use. The Operator will review reported content and reserves the right to remove or correct it.

Reports may be submitted via the reporting function provided within the Service or by email to info@coinatlas.eu.

Reports should include a description of the affected content that is as precise as possible, a reason why the content is unlawful or violates these Terms of Use, and contact details. The Operator will review reports in a timely, careful, and non-discriminatory manner. If content is removed or blocked, or if a user account is restricted, the affected user may request a review of the decision via the contact option provided.

5. Use of Interfaces (API)

Access to the Coin Atlas application programming interfaces (APIs) is permitted only via the official Coin Atlas clients, in particular the website as well as the official Android and iOS apps, or with the Operator's prior express consent. Automated use by third-party applications, scripts, bots, scrapers, or other unauthorized clients is prohibited.

6. Availability

The Operator endeavors to provide the Service with as few interruptions as possible, but does not guarantee uninterrupted availability. Maintenance work, technical disruptions, or force majeure may lead to temporary restrictions.

The availability of the Android and iOS apps may additionally depend on the respective app store providers, operating systems, end devices, and their technical requirements.

7. Liability

  • The Operator is liable in accordance with statutory provisions for intent and gross negligence as well as in cases of mandatory statutory liability, in particular when assuming guarantees, under the Product Liability Act, and for culpable injury to life, body, or health. In the case of a slightly negligent breach of essential contractual obligations, the Operator's liability is limited in amount to the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose fulfilment makes the proper use of the platform possible in the first place and on whose observance users may regularly rely.

  • Any further liability of the Operator is excluded to the extent permitted by law.

  • Insofar as the Operator's liability is excluded or limited, this shall also apply for the benefit of its legal representatives, employees, and vicarious agents.

  • The Operator does not adopt user content as its own. The respective user is generally responsible for user content. Statutory obligations of the Operator to act, in particular upon obtaining knowledge of unlawful content, remain unaffected.

  • The Operator has no influence over how third parties use publicly accessible content in accordance with the license granted. The Operator's liability for actions by third parties remains unaffected in accordance with statutory provisions.

8. Termination

  • You may delete your account at any time without giving reasons via the website as well as within the Android and iOS apps.
  • Publicly provided content (in particular contributions to location data pursuant to Section 4.2) remains available even after deletion of the account due to the license granted.
  • The Operator may terminate the Service or individual accounts with 14 days' notice, or suspend them without notice for good cause (for example in the event of a breach of these Terms).
  • In the event of account deletion, personal data will be deleted or anonymized in accordance with the Privacy Policy, unless statutory retention obligations or legitimate reasons for further processing apply.

9. Changes to the Terms of Use

The Operator may amend these Terms of Use where there is an objective reason to do so, in particular due to changes in the legal situation, the scope of functions, app availability, or for security reasons. Registered users will be informed of material changes in good time by email or within the Service. Material changes only become effective if the user expressly agrees to them. If no consent is given, the Operator may terminate the user relationship with ordinary notice.

10. Final Provisions

  • The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  • If individual provisions of these Terms of Use are or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision shall apply in place of the invalid provision.
  • In relation to merchants, legal entities under public law, or special funds under public law, the place of jurisdiction is, to the extent legally permissible, the registered office of the Operator.
